Effective date: 2026-09-24. These terms govern your use of www.varcommerce.com and its subdomains (the "Site") operated by VARCommerce, Inc. ("VARCommerce", "we"). Use of the VARCommerce software platform is governed separately by the customer agreement between VARCommerce and your company; where the two conflict for platform use, the customer agreement controls.

Using the Site

You may use the Site for lawful purposes to learn about VARCommerce and contact us. You agree not to interfere with the Site's operation, attempt to gain unauthorized access to any system or data, submit false or misleading information through our forms, use automated tools to submit forms or scrape content beyond normal search-engine indexing, or use the Site to send unsolicited communications.

Content and intellectual property

The Site and its content, including text, graphics, logos, screenshots, documents, and software, are owned by VARCommerce or its licensors and are protected by copyright and trademark law. VARCommerce and the VARCommerce logo are trademarks of VARCommerce, Inc. You may view and download material for your own evaluation of our products. Any other use, including reproduction or redistribution, requires our written permission. Names of other companies and products mentioned on the Site, including distributors and software vendors we integrate with, are trademarks of their respective owners and are used for identification only; no endorsement is implied.

Comparisons and product information

Comparison pages and product descriptions reflect our understanding of publicly available information at the time they were written and our own product as of that date. They are provided for general information, are not a substitute for your own evaluation, and may become out of date. We correct errors when they are brought to our attention; email support@varcommerce.com.

Demo requests and trials

Submitting a demo or contact form is a request for information and does not create a contract. Any trial or subscription is offered under the terms provided when it is set up.

Third-party links and services

The Site links to and uses third-party services (for example, social networks, analytics, and bot protection). We are not responsible for the content or privacy practices of third parties. Your use of those services is subject to their terms.

Disclaimer

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, VARCommerce and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business, arising from your use of or inability to use the Site. Our total liability for any claim relating to the Site will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow these limitations, so they may not apply to you.

Governing law

These terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Franklin County, Ohio, and you consent to their jurisdiction.

Changes

We may update these terms by posting a new version on this page with a new effective date. Continued use of the Site after a change means you accept the new terms.
